923.12 BOND.

   (a)   If a SWP3 or Abbreviated SWP3 is required by this Chapter, then a performance and maintenance bond shall be posted according to the Subdivision Regulations. No project will be released from the bond if there is failure to comply with an approved SWP3.

   (b)   The bond will be retained until all areas disturbed by construction activity are permanently stabilized. Where vegetative growth is used to achieve permanent stabilization, the area shall comply with final stabilization requirements of the Construction General Permit.

   (c)   No project subject to this regulation shall commence without a SWP3 or Abbreviated SWP3 approved by the City Engineer.

   (d)   Upon the failure of the owner and/or developer and/or contractor(s) to complete any work ordered by the City Engineer, the City may elect to contract with others or employ its own employees to remedy all or part of the said unfinished work and the owner and/or developer and/or contractor(s) shall be liable to the City of Macedonia for the cost of such work and for the cost to the City to collect its costs if not paid upon presentment. The City shall have the right to enter upon the disturbed lands to correct such failure and to abate any nuisance found.
