311.02 PARADE PERMIT REQUIRED.
   (a)   “Parade” means an organized procession or march by people and/or vehicles through the streets or public property within the Municipality.
   (b)   An assembly of people for a parade through the streets or other public property of the Municipality is lawful only upon the issuance of a permit therefor by the Mayor. Such parade may be held only at the time, date and location specified in the permit issued by the Mayor.
   (c)   The Mayor is authorized to issue a permit for a parade upon payment by the applicants therefor of a permit fee of five dollars ($5.00) upon determination by the Mayor that:
      (1)   The public will not be unduly inconvenienced by the proposed parade;
      (2)   Such parade will not be inimical to the welfare of the community and the residents thereof;
      (3)   The safety of the participants in such parade or the residents of the community will not be jeopardized by the proposed parade;
      (4)   Vehicles and other traffic through the Municipality will not be unreasonably obstructed by the proposed parade.

   (d)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
