913.01 EROSION PLAN REQUIRED.
   (a)    Every person who proposes to:
      (1)    Improve land by the construction or erection of a building or by structures of any kind, or by the construction, installation and maintenance of roadways, water mains, sanitary and/or storm sewers, or by any other type of improvement to land; or
      (2)    Change the contours of land by grading or excavating; or
      (3)    Remove or destroy the natural topsoil;
hereinafter these described purposes shall be referred to as "improvements", shall submit to the Building Department preliminary plans, including maps generally describing the proposed improvements. Upon finding that erosion and sediment control measures are not necessary the Building Department shall issue the necessary permits.
   (b)    In the event that the Building Department determines that the proposed improvements may result in erosion and/or siltation of adjoining or nearby property, it shall, within three working days of receipt of such plans and maps, inform the applicant of its findings, and then such applicant shall submit to the Building Department for approval a plan for erosion and sedimentation controls, together with a report of the Summit Soil and Water Conservation District. Any such improvements proposed by a person relative to streets, bridges, roadways, highways and/or associated areas shall also be submitted to the City Engineer for determination as to whether erosion and sedimentation control measures are necessary. Should the Building Department and City Engineer disagree as to the necessity of erosion and sedimentation controls, the City Engineer shall make the final determination. If erosion and sedimentation control measures are deemed necessary, the applicant shall comply with the steps set forth in this chapter.
