751.09 VARIANCE FROM DEVELOPMENT STANDARDS.

   As part of the conditional use procedures of the Planning Commission used to review an application for an oil or gas well permit, the Planning Commission may authorize, in specific cases, variance from the development standards. In reviewing the applications for development standard variances, the Planning Commission shall follow the requirements for granting variances as are set forth in Section 1135.03(b) and 1135.04(b) of the Planning and Zoning Code of the City of Macedonia in addition to the conditional use procedures set forth in Section 1137.04 of the Planning and Zoning Code.
