751.05 FUTURE DEVELOPMENT ADJACENT TO WELL AND STORAGE SITES.

(a) No buildings for human occupancy shall be constructed on a well site except in compliance with the distances from the well and storage equipment specified in Section 751.03(b).

(b) After a well is no longer operational and has been plugged to the satisfaction of the City and the Division of Oil and Gas upon approval from the City’s Fire Inspector and the Building Commissioner a building and/or structure may be constructed thereon the well site or in close proximity thereto.
