521.17 STORAGE, SALE AND MANUFACTURE OF LIQUIFIED PETROLEUM GAS.
   Liquified petroleum gas (LPG) shall used, stored or sold in the City only as set forth herein. LPG shall not be manufactured in the City.
   (a)   In residential areas, i.e. areas zoned residential or which are subject to legal residential uses in existing commercial or industrial districts, the following regulations apply.
      (1)   LPG tanks for the purpose of home heating may be installed and used only upon the approval of the Fire Chief pursuant to this and other applicable regulations.
      (2)   No retail sales or wholesale sales or commercial storage of LPG tanks shall be permitted in residential areas.
      (3)   LPG tanks to a maximum of 175 pound water capacity (twenty-one gallons nominal value) shall be permitted in automobiles on residential lots when such tanks are permanently installed in a motor vehicle and intended to provide engine fuel.
      (4)   LPG tanks to a maximum of three in number, each having a maximum water capacity of fifty pounds (six gallons nominal volume), shall be permitted in recreational vehicles or residential lots, provided that all tanks are at all times installed and stored on the vehicle and the placement of all tanks meets the installation requirements of the National Fire Code.
      (5)   LPG tanks more than two and one half pounds water capacity, and not exceeding twenty pounds water capacity (two and one half gallons nominal volume), may be stored or used in residential areas of the City so long as the intended use or storage is for a residential purpose; provided that the storage and use of tanks is prohibited in dwellings, including the basement and enclosed porch, and any other habitable building, and in automobiles, trucks, buses, self-propelled recreation vehicles, campers and recreation trailers, except as permitted in subsection (3) and (4) above.
      (6)   LPG tanks of two and one half pounds water capacity or less may be used or stored in residential area when used for residential purposes.
   (b)   In commercial areas, the following regulations apply.
      (1)   A retail store may sell LPG in tanks not exceeding two and one half pounds water capacity but only upon written approval by the Fire Chief pursuant to this and other applicable regulations.
      (2)   No other LPG tanks for sale or storage shall be permitted in any commercial district.
   (c)   In industrial areas, the following regulations apply.
      (1)   In a Limited Industrial District, LPG tanks or facilities shall be permitted only when they are located inside a completely enclosed structure in compliance with district regulations, provided that such building shall be specially provided for this purpose in compliance with the requirements of the Fire Protection Handbook, N.F.P.A. Standard for Storage and Handling of L.P. Gas #58 and #59, and further provided that such tanks or facilities may be located and installed only upon the written approval of the Fire Chief pursuant to this and other applicable regulations.
      (2)   In a General Industrial District, LPG tanks and facilities shall only be permitted if they are located inside a structure which complies with subsection (c)(1) above; but if located outside a structure, such tanks and facilities shall only be permitted if they comply with distance and space requirements prescribed by Table F-3001 of the Ohio Fire Code and are not located in any required setback according to the zoning code. Such tanks and facilities shall be located and installed only upon the written approval of the Fire Chief pursuant to this and other applicable regulations.
   (d)   All tanks permitted by this regulation shall be installed, mounted, stored and/or filled in compliance with all applicable codes and regulations which include, but not limited to the Ohio Fire Code, Fire Protection Handbook, Ohio Pressure Piping Code, Fire Protection Code or modifications thereto.
   (e)   Any contractor or person proposing to use LPG during building construction or renovation shall first give written notification to the Fire Chief stating the place, purpose and time period for such use. Propane shall not be used during construction unless and until authorized in writing by the Fire Chief. In addition to the requirements of subsection (d) hereof, the Fire Chief may establish additional requirements during construction and renovation as are necessary for safety and consistent with the purpose of this and other applicable regulation.
