12-8-4: AMENDMENTS TO CODE:
All references to the international existing building code shall be amended to designate the building codes as amended and adopted by the village, and as may apply.
All references to the international zoning code shall be amended to designate the village zoning ordinance.
101.1: Insert "The village of Lyons" where the name of jurisdiction is required.
Section 102.7: The last sentence shall be amended to provide that "...the stricter standard shall apply".
Section 103.1: Shall be amended to provide that the building department for the village shall be the department of property maintenance inspection for purposes of this code.
Section 103.5: Insert: "Fee schedule contained in title 12 of the Lyons village code."
Section 104.3: Shall be amended to strike the word "shall" and substitute the word "may".
Section 105.1: Shall be amended to add the following sentence: "Modifications shall only be granted where there is a significant and documented hardship that is not solely financial in nature."
Section 106.3: Shall be deleted in its entirety.
Section 107.3: Shall have the following sentence added: "For purposes of service, notice may be mailed to the taxpayer of record, as contained in the records of the Cook County or Lyons Township assessor."
Section 107.5: Shall be deleted and the following language added: "The code enforcement officer may allow the transfer of property with minor violations of this code, provided, such transfer shall be with the written acceptance of the purchaser, and, shall be accompanied by such performance bond and reasonable conditions and deadlines as determined reasonable by the code enforcement officer."
Section 108.3: Shall be amended to add the following sentence: "In instances where the code enforcement officer is denied permission to access the property or equipment, the requirement for posting is hereby waived."
Section 109.1: Shall be amended to add the following sentence: "The code enforcement officer may make such rules as he determines reasonable for access to the structure while it is in imminent danger as depicted in this section, including but not limited to, hours of permitted access, persons or entities permitted to access the structure, and, exclusion of activities."
Section 111.1: Shall be deleted in its entirety and the following sentence added: "Due Process. Any person or entity charged with a violation of this code may, upon conviction by a court or code hearing officer of competent jurisdiction, appeal such decision to a court of competent jurisdiction. Such appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or the requirements of this code are adequately satisfied. Application for review shall be made in the manner and time required by law following receipt of notice of violation."

Sections 111.2 through 111.6: Shall be deleted.
Section 201.3: Shall be amended to substitute "the village of Lyons zoning ordinance" for the "international zoning code, substitute "the state of Illinois plumbing code", for the "international plumbing code", substitute the "2000 Chicago electrical code and the "2006 ICC international residential code" for the "ICC electrical code" and delete the "international existing building code".

Section 302.1: Shall have the following sentences added: "Upon failure to comply with the notice of violation, any duly authorized employee of the jurisdiction or contractor hired by the jurisdiction shall be authorized to enter upon vacant property in violation to remove junk, rubbish, debris, organic and inorganic material and outdoor accumulations of salvageable or nonsalvageable items so as to eliminate blighting, nuisance and/or hazardous conditions. The cost of such removal shall be invoiced to the property owner, and, all unpaid invoices shall be placed as a lien against the property."
Section 302.1: Shall further be amended to add the following sentence: "In addition to the general requirements of this section, no owner or occupant of a building or real estate shall accumulate or permit the accumulation of rubbish, boxes, lumber, scrap metal, plastic or any other materials or goods in such a manner that such accumulation or storage thereof may provide a blighting influence, rat harborage or fire hazard."
Section 302.2: Shall have the following language added to the end of the last sentence, "..., or, drainage to any other property that creates flooding or other nuisance or hazardous conditions."
Section 302.4: Insert "8 inches in height" where code requires insertion.
Section 302.8: Shall be amended to substitute following language for "Exception": "A vehicle is permitted to undergo repairs, as permitted by the Lyons zoning ordinance, provided such repairs and the storage of such vehicle is conducted in an approved, enclosed accessory structure designed, permitted and constructed for such purposes."
Section 304.3: Shall have the following sentence added: "Such address numbers shall also be posted on the wall of any garage facing an open alley, and, such number shall be plainly visible."
Section 501.3: Add new section stating: "The absence of hot and cold running water shall be prima facie cause for declaring a structure unsafe for human habitation."
Sections 602.3 and 602.5: Insert dates "from September 30 to May 1" and add following sentence to both sections: "Such minimum heat shall also be provided whenever the outside temperature, as recorded by the code enforcment officer utilizing a thermometer in the immediate vicinity of the subject structure, falls below sixty five degrees Fahrenheit (65°F)."
Section 604: Replace all references to the international electrical code with: "The Chicago electrical code and the international residential code, as amended and adopted by the village of Lyons."
Section 604.2: Substitute "60 amperes" with "100 amperes".
Section 701.3: Amend section 701.3 substituting the "international fire code" with the "NFPA life safety code and fire prevention code, as amended and adopted by the village of Lyons".
