12-1-3: CERTIFICATE OF OCCUPANCY 1 :
   A.   Certificate Required: A certificate of occupancy is required prior to each new occupancy by commercial, industrial or similar uses in all nonresidential zoning districts within the village and/or occupancies requiring a village business license. A new occupancy shall include a change in business ownership, change in use and/or change in occupancy. (1965 Code § 7-16-2)
   B.   Compliance Required: A standard condition for all certificates of occupancy shall require all premises and buildings to be maintained in compliance with village building, zoning and fire codes, as well as the latest version of the village property maintenance code. (1965 Code § 7-16-6)
   C.   Inspections:
      1.   An inspection shall be performed by the building director prior to the issuance of a certificate of occupancy. Such inspection shall verify that the property is in compliance with all building, fire, property maintenance and zoning regulations of the village. A certificate of occupancy shall not be issued without such verification. An exception to this requirement is that a conditional certificate may be issued if there are minor violations, and the new owner or occupant provides a signed affidavit accepting responsibility for correcting such violations within a specified period time as determined by the building director, not to exceed six (6) months.
      2.   The primary standard for occupancy inspections shall be the latest version of the ICC international property maintenance code, the village zoning ordinance, the village sign ordinance and the latest version of the NFPA life safety code. Applicable sections of the village building, electrical, plumbing and mechanical codes may also be applied. (1965 Code § 7-16-2)
   D.   Suspension Of Certificate: A certificate of occupancy shall be suspended in the event that an owner or occupant of the building or premises for which the certificate has been issued is convicted or found responsible by a court or code hearing department of competent jurisdiction of being in violation of one or more of the codes enumerated in subsection B of this section. The subject property shall thereafter not be occupied and not operate in any manner until such time as the attendant violations have been cured and the corrections verified by the building director.
