9-10-4: ABANDONED, WRECKED OR INOPERABLE VEHICLES ON PUBLIC PROPERTY:
   A.   Storing, Parking Or Leaving Dismantled Or Inoperable Vehicles Prohibited: It shall be unlawful for any owner or any person in charge of a vehicle or other personal property to park, store, leave or permit the parking, storing or leaving of any vehicle of any kind which is in an abandoned, wrecked, dismantled, inoperable, rusted, junked or partially dismantled condition, whether attended or not, upon any street or other public property within the village for a period of time in excess of seventy two (72) hours.    B.   Notice Prior To Removal:
      1.   Any vehicle left at any place within the village on any street or other property in violation of subsection A of this section shall not be removed and impounded as provided herein until the police department shall have given written notice to remove said vehicle seventy two (72) hours prior to the intended removal date. Such notice shall be given by:
         a.   Affixing notice on such vehicle; and
         b.   Sending notice by mail to the owner of such vehicle at his last known address if the owner is reasonably ascertainable.
      2.   The notice shall contain the request for removal within the time specified in this chapter, and the notice shall advise that upon failure to comply with the notice to remove, the village or its designee shall undertake such removal with the cost of removal to be levied against the owner.    C.   Removal Of Vehicle: If, after proper notification as outlined in subsection B of this section, the vehicle is not removed by the owner, the police department shall remove or have removed any vehicle left at any place within the corporate limits of the village on any village property which reasonably appears to be in violation of subsection A of this section or lost, stolen or unclaimed. Such vehicle shall be impounded until lawfully claimed or disposed of in accordance with 625 Illinois Compiled Statutes 5/4-204 to 5/4-213. (1965 Code § 10-11-15; amd. 2009 Code)
