A. Definitions: For the purpose of this section, the following terms shall have the meanings ascribed to them in this subsection:
ACCESSIBILITY: The means by which a disabled person overcomes physical barriers to access his residential property.
DISABLED PERSON: Any resident of the village who has met the criteria of the state of Illinois for obtaining and has actually obtained a handicap license plate or motor vehicle placard.
HANDICAP PARKING SIGN: A sign erected by the village decreeing a specific public area to be for motor vehicle parking by handicapped persons only.
B. General Requirements:
1. Request For Sign: All requests for handicap signs shall be in accordance with this section.
2. Condition For Issuance: A handicap parking sign shall only be issued under the following prerequisites:
a. The disability must be permanent in nature as determined by the Illinois secretary of state.
b. Only the resident for which the handicapped signage is issued shall be parked in the designated handicapped space.
c. The applicant must hold title to the vehicle for which the signage has been installed.
d. The applicant must reside at the address at which the sign is requested.
e. If the residence for which the signage is requested includes a driveway or garage, and if the distance from the driveway or garage is less than the distance from the requested handicapped designated parking space, then no handicapped parking sign will be installed.
3. Reasons For Denial Of Request Or Removal Of Sign: The village shall deny an application for a handicap sign or remove a handicap sign for one or more of the following reasons:
a. Fraudulent or misleading information provided on an application.
b. The applicant is not disabled or has recovered from his disability.
c. The applicant no longer lives at the subject address.
d. A nuisance or hazardous condition will be created by the installation of the sign and/or its attendant handicap parking space.
C. Application Requirements:
1. Filing Of Application With Police Department: Persons seeking the issuance of a handicap parking sign shall fill out an application for such sign at the police department.
2. Documentation Of State Plate Or Placard: The applications shall be submitted with documentation from the state of Illinois establishing that the applicant has obtained a handicap license plate or placard from the state.
3. Proof Of Residency Adjacent To Sign Location: Proof of residency adjacent to the public sign location shall be presented with the application.
4. No Fee: There shall be no fee for the application. (Ord. 08-18-09-01, 8-18-2009)
