8-3-9: IMPOUNDMENT; NOTICE; REDEMPTION:
   A.   Place Of Impoundment Designated; Impoundment Authorized: The village manager shall designate a place or places for the purpose of impounding dogs, cats and other animals. It shall be the duty of all police officers to seize and impound any and all animals running at large in the village, and the owner or keeper of such animal shall pay the impoundment fee agreed upon between the village manager and the designated pound. (1965 Code § 9-7-38)
   B.   Notice To Owners:
      1.   Upon the impounding of any animal, the village shall notify the owner or keeper of the animal, personally or by mail, of such impounding, unless the owner or the keeper is unknown and cannot be found. The notice shall advise the owner or keeper that unless he applies for redemption of the animal, the animal will be destroyed or disposed of by the village at the end of three (3) days, unless a dog is impounded because it is considered or alleged to be dangerous, fierce or vicious, or that it has bitten or injured or attempted to injure any person, or because it is suspected of having rabies. In any of these instances, the period shall be fifteen (15) days instead of five (5) days after the notice has been given.
      2.   If the owner of the impounded animal cannot be identified, the animal will be destroyed or disposed of as the village manager shall determine and direct. (1965 Code § 9-7-39)
   C.   Redemption Of Animals:
      1.   Except as herein provided, any animal impounded may be redeemed by the owner or keeper thereof at any time before the destruction, sale or other disposition of such animal, upon payment of the redemption fee charged by the pound per day, or fraction thereof, to defray the cost of keeping the animal, any pick up fee charged, and if the dog is not already licensed, payment of a full annual license fee for the current license year.
      2.   If a dog impounded is held on complaint that it is dangerous, fierce or vicious, or that it has disturbed in any manner the quiet of any person or neighborhood, or that it has bitten or injured or attempted to injure any person, such dog shall not be redeemed until such complaint has been disposed of, and then only if permitted under the order of the court which passes on such complaint.
      3.   No redemption shall be made of any dog suspected of having rabies unless and until it has been determined that the dog is not so afflicted. (1965 Code § 9-7-40)
