(A) Fund established. Pursuant to State Examiner Directive 2021-1, the Town Council does hereby create Fund #176 which is designated as the ARP Coronavirus Local Fiscal Recovery Fund and shall be the depository fund for allocations received through the ARP. All expenditures must be appropriated by Council.
(B) Permitted uses. The Fiscal Officer shall develop a plan to utilize the funds only for the following purposes, as permitted by law. The plan shall be adopted by the Town Council by ordinance or resolution. The plan may be amended in the future as additional state and federal guidance is provided. The plan may include expenditures as permitted by Section 603 (c) of the ARP as follows:
(1) To respond to the public health emergency with respect to the Coronavirus Disease 2019 (COVID-19) or its negative economic impacts, including assistance to households, small businesses and nonprofits, or aid in impacted industries such as tourism, travel, and hospitality;
(2) To respond to workers performing essential work during the COVID-19 public health emergency by providing premium pay to eligible workers of the Town of Lynnville that are performing such essential work, or by providing grants to eligible employers that have eligible workers who perform essential work;
(3) For the provision of government services to the extent of the reduction in revenue of the Town of Lynnville due to the COVID-19 public health emergency relative to revenues collected in the most recent full fiscal year of the Town of Lynnville prior to the emergency; or
(4) To make necessary investments in water, sewer or broadband infrastructure.
(C) Internal controls. Internal controls shall be designated, implemented, and documented to provide reasonable assurance that the ARP funds will be safeguarded and used in accordance with the ARP.
