§ 33.40 ESTABLISHMENT.
   (A)   The Town of Lynnville Department of Redevelopment (the “Department”), controlled by a board of five members, who must be residents of the town, to be known as the “Town of Lynnville Redevelopment Commission” (the “Commission”), is hereby created, and established.
   (B)   In accordance with I.C. 36-7-14-6.1(a) of the Redevelopment Commission Act, three members of the Commission shall be appointed by the Town Council President and two members of the Commission shall be appointed by the Town Council. The Town Council President shall also appoint an individual as a nonvoting advisor to the Redevelopment Commission in accordance with I.C. 36-7-14-6.1(d).
   (C)   The Department shall be governed by the Redevelopment Commission Act, and the Commission shall have the power and authority to do and perform all things now and hereafter granted to it by the Redevelopment Commission Act.
   (D)   All the territory within the corporate boundaries of the town shall constitute a taxing district for the purpose of levying and collecting special benefit taxes as provided in the Redevelopment Commission Act.
   (E)   A redevelopment authority, designated as the “Town of Lynnville Redevelopment Authority” (the “Authority”), controlled by a board of three members, is hereby created and established for the purposes and with all rights, powers, privileges, and immunities now or hereafter granted to it by law, as a separate body corporate and politic and as an instrumentality of the town.
   (F)   In accordance with Section 8 of the Redevelopment Authority Act, the three board members, who must be residents of the own, shall be appointed by the Town Council President.
