§ 92.23 GRASS CLIPPINGS AND OTHER VEGETATION PLACED ON PUBLIC STREETS.
   (A)   Any person may notify the Lynnville Clerk-Treasurer or the Lynnville Town Superintendent, orally or in writing, of grass clippings and/or other vegetation having been blown or placed on public streets from private property. Upon notification, the Town Superintendent shall notify the owner or possessor of the real estate considered in violation of this section of the violation, in writing. The notice shall, in addition to the reasons for the owner’s or possessor’s violation of this section, state that they shall have five days from the date and time of delivery of the notice to remove the grass clippings and vegetation from the public street. The notice shall be personally delivered to the owner or possessor. If the owner or possessor is not present, the notice shall be left on the premises, with a copy to be mailed, on the same date, to the owner or possessor. The date of delivery shall be the date the notice was personally delivered or the date the notice was left on the premises. The owner or possessor may file with the town a written objection to the notice by delivery to the Lynnville Town Hall within the five days from the delivery of the notice by the town.
   (B)   The Lynnville Town Council, pursuant to the information presented by the complainant and the owner of the real estate, at its next regular meeting, shall determine whether or not this section was violated. If it finds that this section was violated, and not remedied as stated in division (A), the owner or possessor complained of shall, within 24 hours of the finding, remove the grass clippings and vegetation from the public streets.
   (C)   In the event the grass clippings and/or vegetation are not removed within the time specified in this section, the Town Council may authorize the Town Attorney to bring an action in its name in court to enforce this section.
   (D)   Any owner or possesor, or anyone acting on behalf thereof, who violates this section shall be subject to a penalty of $100.
