(A) Termination of employment is an inevitable part of personnel activity and many of the reasons for the termination are routine. Below are examples of some of the most common circumstances under which employment is terminated:
(1) Resignation: voluntary employment termination initiated by an employee;
(2) Layoff: involuntary employment termination initiated by the town for non-disciplinary reasons; or
(3) Retirement: voluntary employment termination initiated by the employee meeting age, length of employment or any other criteria for retirement from the town.
(B) Since employment with the town is based on mutual consent, both the employee and the town have the right to terminate employment at will, with or without cause, at any time.
(C) Employee benefits may be affected by employment termination in the following manner:
(1) One hundred percent accrued vacation days may be paid to employees who retire, resign or get laid off.
(2) One hundred percent accrued personal days may be paid to employees who retire, resign or get laid off.
(3) Twenty-five percent of accrued sick days may be paid to employees who retire, resign or get laid off.
(4) No benefits shall be paid to an employee who is discharged.
(5) Employee will be notified in writing on the benefits they may continue, if any. They will also be notified of the terms, conditions and limitations of such continuance.
