§ 91.07 REPAIR AND MAINTENANCE OF SIDEWALKS.
   (A)   The owners of property abutting sidewalks in the City are required to repair that part of the sidewalk adjoining property respectively belonging to them at their own expense, by repairing any holes, uneven surface, and other defective places therein, by using materials as nearly similar as possible to that of which the sidewalk is constructed.
   (B)   The city, through its authorized representative, may inspect such sidewalks and ascertain the existence of defects and then notify, in writing, the owners of the property abutting that part of the sidewalk which is found to be defective, to repair it at their own expense within 30 days after the delivery of the notice.
   (C)    In the event the owner fails to make necessary repairs, the city shall have the necessary repairs made and will assess the cost of repair to the abutting property owner and notify the property owner of the assessment in writing. In the event the owner fails to remit the costs within 30 days of the assessment notice, the city shall take the necessary steps to place a lien against the real property of the abutting properly owner in the office of the County Clerk of Jefferson County, in the amount of the unpaid assessment.
   (D)   If the sidewalk being repaired is within any right-of-way of the city, and the property owner can produce written proof detailing the cost of its repair, and the city can ascertain the validity of this proof with a reasonable of certainty; then in that event, the city shall pay 50% of the total cost of such repairs. Such proof must be supplied to the city within 60 days of the repair and it is the property owner’s duty to make application for this reimbursement within this time period. The city shall not be obligated to make a reimbursement after this time period bas expired.
   (E)   If the sidewalk being repaired is within any right-of-way of the city, and the city inspects the sidewalk and finds it defective, then in that event the city has the option of repairing the defective sidewalk at the city’s expense and then assessing the abutting property owner 50% of the total repair costs. Written notice of the repair shall be sent to the property owner 30 days prior to the repairs being made. The city will assess the cost of repairs to the abutting property owner and notify the property owner of the assessment in writing. In the event the owner fails to remit the costs within 30 days of the assessment notice, the city shall take the necessary steps to place a lien against the real property of the abutting property owner in the office of the County Clerk of Jefferson County, in the amount of the unpaid assessment.
