Whoever violates any provision of this Traffic Code, for which no penalty otherwise is provided, is guilty of one of the following:
(a) Except as otherwise provided in division (b) or (c) of this section, a misdemeanor of the fourth degree;
(b) If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one violation of any provision of this Traffic Code for which no penalty is otherwise provided or of a state law or municipal ordinance that is substantially similar to any provisions of this Traffic Code for which no penalty is otherwise provided, a misdemeanor of the third degree;
(c) If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to two or more violations of any provision described in division (b) of this section or any state law or municipal ordinance that is substantially similar to those provisions, a misdemeanor of the second degree.
