1351.20 DEMOLITION OR REMOVAL OF PRINCIPAL STRUCTURES ON COMMERCIAL OR INDUSTRIAL PROPERTIES.
   (a)   Requirements Before Demolition or Removal of Principal Structures on Commercial or Industrial Properties. No demolition or removal of a principal structure in the City of Lyndhurst shall be permitted unless and until the following conditions are satisfied:
      (1)   The Safety Director of the City authorizes the Building Commissioner to grant a demolition or removal permit, based on causes such as fire or other source of property damage or loss, in order to remedy conditions immediately dangerous to life, health or property, to remedy a nuisance, as jointly determined and recommended by the Building Commissioner, the Fire Chief, and the City Engineer, or due to owner's representation of the facility's inability to meet the needs of the owner; and
      (2)   The Building Commissioner and City Engineer have reviewed and approved the methodology of demolition, including the requirements for removal of all construction debris and consistency of any backfill materials as well as necessary protections of all surrounding structures and areas; and
      (3)   The Application for demolition must contain a certification from the owner confirming the identity and contact information of the demolition contractor; and
      (4)   The Application for demolition must contain a certification from the City of Lyndhurst, confirming the property is not of historical significance; and
      (5)   The Application for demolition must contain a certification of all appropriate disposal of hazardous and other materials.
   (b)    Demolition or Removal Delay Period. A time period before a demolition or removal permit can be issued may be required by the City Administration or Council in order to permit the City, public agencies, civic groups and other interested parties a reasonable opportunity to study, comment and propose potential alternatives or modifications to the proposed demolition and any new development plans. During such time, if the City and other interested parties deem preservation appropriate, the applicant shall undertake continuing discussions with the City and other interested parties for the purpose of preserving such principal structure.
 
   (c)    Permit. A demolition or removal permit shall comply with the regulations set forth within this Chapter and those in Section 1351.01 and other applicable provisions of the Lyndhurst Codified Ordinances
   (d)    Fees. All fees established pursuant to Chapter 1351 and other applicable provisions of the Lyndhurst Codified Ordinances shall be included with the application.
