SECTION 3.   INCREASING THE DENSITY IN SINGLE FAMILY ZONING DISTRICTS FOR ASSISTED LIVING USE.
   (a)   Neither the Council, any Board, including, without limitation, the Board of Zoning Appeals, or the Planning Commission, nor any other agent, employee, person or organization acting for or on behalf of the City of Lyndhurst, by whatever authority or purported authority shall:
      (1)   Effect a change in the zoning classification or district of any property or area in the City of Lyndhurst increasing the density permitted in a single family zoning district beyond the maximum density proscribed for single family housing with such district to allow assisted living use thereon; or
      (2)   Grant any zoning classification, conditional use permit or variance which would increase the density permitted on any property in any single family zoning residential district for assisted living use; or
      (3)   Grant a zoning classification or variation or conditional us which would permit assisted living in any single family residential zoning district;
unless the change or grant, after adoption in accordance with applicable administrative and/or legislative procedures, is approved at a regular Municipal or general election by a majority vote of the electors voting thereon, in the City of Lyndhurst.
 
   (b)   This amendment shall be severable, and if any section, subsection, part, word or application thereof is held invalid for any reason, such holding shall not invalidate or affect the force and effect of any other section, subsection, part, word or application thereof adopted.
