(a) The Director of Safety and the Chief of Police are hereby authorized and directed to extend the use of the Pistol and Rifle Range in the police facilities to members of police departments from municipalities with which the City has mutual aid agreements or which are members of S.P.A.N. The cost of the use of such Range by such other municipalities shall be eight dollars ($8.00) per man per month, and billings therefor shall be made by the Department of Finance at regular intervals determined appropriate by the Director of Finance. The contracting municipalities shall be obligated to pay the monthly fee for all men or personnel, or eight dollars ($8.00) times the number of men in their respective police departments. If there is any question as to whether a reservation has been made, the records of the Chief of Police or his or her designated firing range officer shall control.
(b) The contracting municipality is responsible for its men and equipment on City of Lyndhurst premises. It will indemnify and save Lyndhurst harmless from any and all liabilities or damage of any nature whatever, directly or indirectly incurred by such employees and representatives in their use of the City of Lyndhurst premises. Such liabilities and damages shall also include Lyndhurst's cost and attorney's fees or the reasonable value thereof if the exact expense is not known. Such municipalities shall further agree that its personnel take the premises as they are, that the premises are satisfactory to them and that they are not business invitees, but mere licensees. The personnel using such Lyndhurst facilities will be instructed as to the meaning of such terms under Ohio law by the legal officer of the City of Lyndhurst. The contracting municipality shall arrange that its personnel will be in the course of their employment of such municipality's business while its personnel are using the aforesaid facilities, much the same as is provided for under typical mutual aid contracts between municipalities, including those between Lyndhurst and communities in its near vicinity.
(c) Municipalities desiring to have their police members use the Pistol and Rifle Range shall cause a copy of this section to be signed, in lieu of preparation of other documents, by the appropriate contract making official or officials of such municipality, and file such signed copy hereof with the Clerk of Council of the City of Lyndhurst.
