No owner or operator of any premises shall maintain or permit to be maintained at or on the exterior property areas of such premises any condition which deteriorates or debases the appearance of the neighborhood, reduces property values in the neighborhood, adversely alters the appearance and general character of the neighborhood, creates a fire, safety or health hazard, or which otherwise creates conditions constituting a nuisance to the public in general or to neighbors in the surrounding area. Such conditions are hereby declared to be a nuisance and shall be corrected in accordance with provisions of Chapter 1383 of this Housing Code. Examples of conditions which violate this section include, but are not limited to the following:
(a) Broken or dilapidated fences, walls or other structures;
(b) Broken, uneven or improperly maintained public sidewalks, private walks or driveways;
(c) Out of use or nonusable appliances, dilapidated automobiles or automobile parts;
(d) Rubbish, unused building materials, rugs, rags or other material hung on lines or in other places on such premises, which materials are not being used for general household or housekeeping purposes; broken, dilapidated or unusable furniture, mattresses or other household furnishings; plastic materials, paints, miscellaneous coverings and/or any other materials, including those described in this section, placed at or on the premises in such a manner as to be patently unsightly, grotesque or offensive to the senses.
(e) No owner, person in control, occupant or other person shall permit a motor vehicle, trailer or similar vehicle to be parked on any lawn, landscaped area, tree lawn, patio or similar type area in the City, provided, however, that upon receipt of approval of the Mayor, a professional food service operator upon entering into an agreement with the City will be permitted to park a motor vehicle or trailer for such food service at the City swimming pools on the landscaped areas near the pools only during the swimming pool season.
(f) Improperly maintained landscaping including untrimmed bushes and shrubs; wild or uncontrolled growth of bushes, shrubbery or trees; grass or groundcover which is not cut, trimmed, or maintained in a reasonable fashion; uncut grass exceeding six inches in height; groundcover exceeding six inches in height; grass or groundcover encroaching upon the sidewalk or driveways; or other deleterious, unhealthful or unsightly growths or noxious matter.
The provisions of this section shall not be construed to amend by implication or otherwise the provisions of Section 1157 07 of the Planning and Zoning Code.
