Whenever application is made for a permit to construct or alter a building or structure within the City, and the Building Commissioner finds that the proposed building or structure is of such design, material, location or intended use that it will result in a substantial impairment or destruction of value in neighboring real estate owned by inhabitants of the City, and he or she further finds that the use of the particular design, material or location proposed, or substantially similar ones, is not reasonably essential to the development of the property proposed to be built on or altered, the Building Commissioner shall refuse to issue the permit, and he or she shall immediately notify the applicant of such refusal and the reason therefor.
The applicant may appeal from the decision of the Building Commissioner to the Board of Zoning Appeals.
