763.03 PERMIT REQUIRED; HEARING; APPLICATION.
   Sales in and out of doors shall be permitted by charitable and religious organizations on the grounds owned or controlled by such organizations, containing permanent buildings wherein their activities are conducted, only with a permit therefor issued by the Building Commissioner. Permission for sales out of doors, other than in permanent buildings, or in non- retail districts, shall be granted by the Building Commissioner if in compliance with the provisions of this chapter. The Building Commissioner is authorized to issue permits, not to exceed two in any one calendar year at any one location as follows: one of the permitted sales events may be for a period not to exceed 30 days duration, and one may be for a period not to exceed 15 days duration. If an applicant is issued a permit for a 30-day sales event and returns for a permit for a second sales event, the second sale may not exceed 15 days in duration, and vice versa.
   If the Building Commissioner finds that in his or her opinion a proposed sales event would be detrimental to the immediate surrounding area due to traffic, odors, type(s) of sale or other general nuisance conditions, he or she shall refer the application to the Board of Zoning Appeals for disposition. A permit shall not be issued, nor will a hearing be held, until an application has been filed with the Building Commissioner at least ten days prior to the date of the hearing before the Board of Zoning Appeals. The application shall be signed and acknowledged by an executive officer of the organization making application or the duly authorized agent of voluntary associations of persons. The application shall contain the following information:
   (a)   The name and address of the organization;
   (b)   The names and addresses of the applicant's principal officer and authorized agents;
   (c)   A copy of the resolution authorizing sales which shall be certified as a true and correct copy of the original thereof by the officer having charge of the applicant's records;
   (d)   A full statement of the general purposes of the organization;
   (e)   The anticipated revenues to be derived from the sale and the disposition to be made of all receipts other than for the cost of the goods;
   (f)   The type and nature of commodities to be offered for sale;
   (g)   A diagram of the property lines of the premises owned or controlled by the applicant, together with the location of the permanent building or buildings thereon;
   (h)   The precise location on the premises where the sales will be conducted and the location of off-street parking on the premises; and
   (I)   The additional information that is required in order to comply with the provisions of this chapter.
