(a) No person shall spit, excrete or expectorate any saliva or sputum upon any sidewalk or upon the floor of any public conveyance, building, theater or assembly hall, except in receptacles provided for such purpose.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree.
