(a) The emission within the City of smoke the density of which is equal to or greater than No. 3 of the Ringlemann Chart as published and used by the United States Bureau of Mines, from any steam roller, derrick, shovel, tar kettle or other similar machine, or from the smokestack or chimney of any building or premises, or from any incinerator, except for six minutes in any one hour, during which time the firebox is cleaned out or a new fire is built therein, is hereby declared to be a nuisance, and may be summarily abated by any member of the Fire Department, in addition to the fine provided for the violation of this section. Such emission of smoke is also declared to be a misdemeanor, and any person causing the same or permitting the same from such premises or machines within his or her control shall be subject to the penalty provided in division (b) hereof.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty shall be as provided in Section 698.02.
