3-1-15: REVOCATION AND SUSPENSION:
   A.   Revocation: Licenses issued under the provisions of this chapter may be revoked by the governing body, after notice and hearing.
   B.   Suspension: Licenses issued under the provisions of this Chapter may be suspended by the governing body, the Mayor, law enforcement and or any other person so authorized by the Town.
   C.   Grounds For Revocation: Licenses issued under the provisions of this chapter may be revoked or suspended for any of the following causes:
      1.   Fraud, misrepresentation or false statement contained in the application for license.
      2.   Fraud, misrepresentation or false statement made in the course of carrying on the business.
      3.   Any violation of this chapter.
      4.   The commission or conviction of any crime or misdemeanor.
      5.   Conducting the business in an unlawful manner or in such a manner as to constitute a breach of the peace of the community or individual household, or to constitute a menace to the health, safety or general welfare of the public.
   D.   Notice Of Hearing upon Suspension: Upon suspension, notice of right to have a hearing concerning said suspension shall be given orally by the suspending authority with direction to request a hearing date at the next Town Council Meeting by application at the Town Clerk's Office during regular business hours. Failure to request such a hearing shall be deemed grounds for the revocation of said license.
   E.   Notice of Proposed Revocation: A proposed revocation of a business license without suspension shall be given in writing, setting forth specifically the grounds of complaint and the time and place of a review hearing. Such notice shall be mailed, postage prepaid, to the licensee at his last known address at least five (5) days prior to the date set for hearing.
   F.   Hearing: At a hearing as requested above, the Town Council may revoke the business license, reinstate the license or provisionally reinstate the license on condition of good behavior or any other condition. At the hearing, the Town Council may hear and consider any information they deem relevant concerning the matter of the hearing. (Ord. 2012-11, 1-17-2013; amd.
