A. Generally: No property shall be used as a gaming establishment except as provided in this title. Any place where one or more gaming devices are found is presumed to be intended for use as a gambling establishment.
B. Commercial Zone: Gaming establishments may only be located in areas zoned commercial and they shall be a conditional use in that zone.
C. Application For Permit: A written application shall be made to the planning and zoning commission as provided in section 12-12-7 of this chapter.
D. Signs; Parking: For sign and parking requirements, see chapters 8 and 9 of this title.
E. Exemptions: Gaming activities such as bingo, pulltabs, raffles, etc., used by nonprofit groups as fundraising activities where all the proceeds of such activities go solely to the benefit of that nonprofit organization are exempt from the conditional use requirements. (Ord. 6-94, 10-2-1994)
