12-11-6: REVOCATION OR MODIFICATION:
   A.   Grounds For Revocation Or Modification: A variance may be revoked or modified by the town council, after a public hearing, on any one or more of the following grounds:
      1.   Approval was obtained by fraud.
      2.   The use for which such approval was granted is not being exercised within the time specified in such permit.
      3.   The use for which such approval was granted has ceased to exist or has been suspended for one year or more.
      4.   The permit granted is being, or recently has been, exercised contrary to the terms or conditions of such approval, or in violation of any statute, resolution, law or regulation.
      5.   The use for which such approval was granted has been so exercised as to be detrimental to the public health or safety, or so as to constitute a nuisance.
   B.   Notice Of Intent To Revoke: Written notices of intention to revoke shall be mailed to the owners of the property and the occupants of property not less than fifteen (15) days before the date of the public hearing.
   C.   Appeal: In the event of the revocation by the town council, the applicant may appeal in the same manner as an appeal from a denial of a variance in the first instance. (1987 Code § 17.68.060)
