12-10-1: USES:
If the use of a building, structure or land exists on the effective date hereof, and such a use is not allowed in the district under the terms of this title, the use may be continued so long as it remains otherwise lawful, subject to the following provisions:
   A.   Enlarged, Extended, Constructed, Reconstructed: Unless a conditional use permit is granted, no existing building or structure devoted to a use not permitted in the district in which it is located shall be enlarged, extended, constructed, reconstructed, moved or structurally altered except in changing the use of the structure to a use permitted in the district in which it is located.    B.   Reconstruction: An existing residential building or structure in a commercial (C), light industrial (L-I) or heavy industrial (H-I) zone shall be allowed to be rebuilt at the same location so long as the reconstructed building or structure receives proper building permits and conforms to all other requirements of this code. Such reconstructed residential building shall conform with all standards, including setbacks, inspections and codes as if said residence was constructed in an R-1 zone. (Ord. 2013-06, 1-16-2014)
   C.   Extension Outside Building: Any nonconforming use may be extended through any part of a building which was arranged or designed for such use at the time of adoption or amendment of this title, but no such use shall be extended to occupy any land outside such building.
   D.   Changed To Another Nonconforming Use: A nonconforming use may not be changed to another nonconforming use.
   E.   Superseded By Permitted Use: Any building, structure or land use, in or on which a nonconforming use is superseded by a permitted use, shall thereafter conform to the regulations for the district in which it is located and the nonconforming use may not thereafter be resumed.
   F.   Discontinued Or Abandoned: When a nonconforming use is discontinued or abandoned for ninety (90) consecutive calendar days, the building, structure or land shall thereafter only be used in conformance with the regulations of the district in which it is located. (Ord. 2007-8, 5-1-2007)
