A. Permit Required: Except as specified in the Building Code, it is unlawful for any person, firm, partnership, corporation or other business entity, to construct, add to, alter, move or demolish any building or structure within the Town without first obtaining a permit thereof.
B. Requirements Prior To Issuance: The permit shall not issue without first obtaining the following:
1. A drawing, plan or sketch showing a site plan which conforms to existing Town zoning laws;
2. A blueprint or plans of the structure with the builder's and/or owner's certification that the building meets or will comply with the Building Code; and
3. A written application and the appropriate fee.
C. Mobile Home, Manufactured Home, Modular Home Or Prefabricated Home Not Meeting Building Code Standards 1 : Any mobile home, manufactured home, modular home or other prefabricated home which does not or cannot meet the standards set forth in the Building Code shall secure a setup permit and shall comply with the provisions set forth in title 12 of this Code. All other work as defined above shall require a building permit. (Ord. 16-00, 12-21-2000, eff. 1-1-2001)
D. Term: Any permit obtained under this section shall be valid for a period of one year from the date of issuance. Permittees who have exceeded the building permit term may be granted one automatic six (6) month extension if applied for and pay a fifty dollar ($50.00) extension fee. Any subsequent extensions must be approved by the Planning and Zoning Commission and ratified by the Town Council with an additional extension fee and further required progress benchmarks. Permits which exceed any nonextended time period shall be considered null and void. A null and void building permit may be renewed only by the initiation of a new building permit application with all associated fees and costs, and must comply with any new building standards adopted in this Code.
E. Nuisance: Construction or placement of a building within the Town without obtaining a building permit or after the expiration of a building permit, or allowing the continued placement or accumulation of construction materials on a lot for more than two (2) weeks absent an active building permit shall constitute a misdemeanor punishable by not more than seven hundred fifty dollars ($750.00). Each day or continued placement or accumulation may constitute a separate offense. (Ord. 2012-02, 5-3-2012)
F. Small accessory buildings: Accessory buildings with a footprint less than 200 square feet and without electricity and/or plumbing are not required to have a building permit. The exemption herein does not exempt the accessory building from compliance with all other sections of the Town Code.
G. Commercial Remodel: In addition to the requirements above, any modification of a commercial property and/or transformation of an existing property to a commercial purpose, requiring construction, removal, or alteration of the load-bearing walls, plumbing, foundations, and/or electrical wiring requires approval by the Town Council. In granting such a permit, the Council may require any lawful contingent condition on the granting of such a building permit.
H. Exemptions: The following structures are exempt from the requirement of having a building permit before construction and/or remodeling:
1. Accessory buildings with a footprint less than five hundred (500) square feet unless said building has permanent plumbing and/or electricity.
2. Greenhouses after submission of a site plan demonstrating intended compliance with easement and setbacks.
3. Unroofed decks less than thirty-six (36) inches off the ground.
