§ 111.060 LIQUOR LICENSE REQUIRED.
   (A)   It is unlawful for any person, directly or indirectly, on any pretense or by any device to sell, barter, keep for sale or otherwise dispose of liquor, as part of a commercial transaction, without a license therefor from the city. This section shall not apply:
      (1)   To such potable liquors as are intended for therapeutic purposes and not as a beverage;
      (2)   To industrial alcohol and its compounds not prepared or used for beverage purposes;
      (3)   To wine in the possession of a person duly licensed under this chapter as an on-sale wine licensee;
      (4)   To sales by manufacturers to wholesalers duly licensed as such by the Commissioner;
      (5)   To sales by wholesalers to persons holding liquor licenses from the city; or
      (6)   To the Municipal Liquor Store.
   (B)   The city may issue annual on-sale liquor licenses only to the following:
      (1)   Hotels;
      (2)   Restaurants;
      (3)   Bowling centers; and
      (4)   Clubs or congressionally chartered veterans organizations with the approval of the Commissioner; provided that, the organization has been in existence for at least three years and liquor sales will only be to members and bona fide guests, except that a club may permit the general public to participate in a wine tasting conducted at the club under M.S. § 340A.419, as it may be amended from time to time.
   (C)   The city may issue an on-sale intoxicating liquor license, an on-sale wine license or an on-sale malt liquor license to a theater within the city, notwithstanding any law, local ordinance or charter provision. A license issued under this division (C) authorizes sales on all days of the week to persons attending events at the theater.
   (D)   On-sale wine license and an on-sale malt liquor license to a person who is the owner of a summer collegiate league baseball team or baseball team competing in a league established by the Minnesota Baseball Association, or to a person holding a concessions or management contract with the owner, for beverage sales at a ballpark or stadium located within the municipality for the purposes of summer collegiate league baseball games, town ball games, and any other events at the ballpark or stadium, notwithstanding any law, local ordinance, or charter provision. A license issued under this paragraph authorizes sales on all days of the week to persons attending baseball games and any other events at the ballpark or stadium.
   (E)   The city may issue Sunday on-sale intoxicating liquor licenses only to a restaurant, club or hotel which has a seating capacity of at least 30 persons, which holds an on-sale intoxicating liquor license, and which serves liquor only in conjunction with the service of food.
   (F)   An on-sale intoxicating liquor license, on-sale wine license, or an on-sale malt liquor license may be issued to a convention center located within the city pursuant to M.S. § 340A.404, subd. 1(c), as it may be amended from time to time. A license under this division authorizes sales on all days of the week to persons attending events at the convention center subject to the hours of sale provisions of this Code.
