§ 37.22 RETIREMENT AND RE-HIRE.
   (A)   (1)   Under current Kentucky law, police officers can retire and then be eligible for re-hire by the city after having had their relationship with the city severed for a minimum of 30 days.
      (2)   The Civil Service Commission shall therefore create a list which shall be called the “retired and eligible for re-hire list” and shall place upon this list the names of any and all police officers who retire from active service to the city and who advise the city in writing within 30 days of their retirement that they wish to be placed on this list.
   (B)   The Mayor may make an appointment to fill a vacancy in the police department by utilizing any name on the retired and eligible for re-hire list by executive order. The Mayor may utilize this list and have it take precedence over the civil service examination list (recruits) or the lateral entry eligibility list.
   (C)   In the event that a police officer is hired from the retired and eligible for re-hire list, upon recommendation of the Chief of Police, the Mayor may hire that person at the rank at which they were serving at the time of retirement.
   (D)   Any police officer hired from the retired and eligible for re-hire list shall have their previous service with the Ludlow Police Department applied to their length of service and it may be taken into account in consideration of promotions and pay; and they shall be eligible for 25 days vacation per year.
   (E)   Any police officer hired from the Retired and eligible for re-hire list shall be required to sign an employment contract with the city which provides that they will continue in employment with the city for a minimum of three years from the date of the signing of the contract and shall execute a waiver of insurance form stating that the employee has health insurance, and will maintain in effect a health insurance policy during their re-employment with the city; there will be no eligibility for insurance waiver payments.
