(a) No building or premises shall be erected, structurally altered, or used for any other purposes except as herein provided:
(1) Single Family Dwelling
(2) Two Family Dwelling
(3) Multifamily Dwelling
(4) Hotels, Motels, Apartment hotels and Rooming houses
(5) Public Uses and Quasi-public uses
(6) Clinics, Hospitals, Nurseries, Nursing Homes
(7) Community Garages
(8) Cemeteries
(9) Accessory uses customarily incidental to the above uses; provided however, that the following accessory uses shall be permitted as a conditional use, requiring prior approval from the Zoning Board of Appeals:
A. Parking Areas
(10) Essential services customarily provided for the above uses
(11) Agricultural uses may be permitted in a "B Residence" District as a conditional use, requiring prior approval from the Zoning Board of Appeals.
(12) In the home businesses may be allowed as a conditional use requiring prior approval from the Board of Zoning Appeals where it is clearly incidental and secondary to the use of the premises for residential purposes, and does not change the character thereof. In the home businesses shall be subject to the following conditions:
A. No in the home business shall be permitted until an application for a In The Home Business Conditional Use Permit is reviewed and approved by the Board of Zoning Appeals.
B. An In The Home Business Conditional Use Permit shall be issued only to a resident of the premises in which the in home business is to be conducted. If the resident rents the premises, the resident shall provide evidence of written permission from the premises' owner as part of the permit application.
C. In The Home Business Conditional Use Permits shall not be transferable, shall not run with the land, and shall expire upon the sale, transfer, or lease of the property to a new owner or tenant.
D. Prohibited In Home Businesses. The following uses and activities shall not be permitted as or conducted as an in the home business:
1. Funeral Homes
2. Hair care, salon, tanning studio, or similar personal services
3. Hotels, motels, bed and breakfast facilities
4. Professional offices of physicians, dentists, or other medical related services
5. Restaurants
6. Sexually-oriented businesses
7. Vehicle or equipment sales or rental
8. Veterinary facilities and/or small animal clinics or kennels
E. Workforce. No one other than members of the family residing in the dwelling unit shall be engaged in the in home business.
F. The use of the premises for an in home business shall be clearly incidental and subordinate to its use as a residential dwelling.
G. In the case of electrical interference, no equipment or process shall be used which creates visual or audible interference in any radio or television receivers or causes fluctuations in line voltages off the premises.
H. An in home business shall provide off-street parking area adequate to accommodate all needs created by the in home business in addition to the requirements for the principle use of the premises.
I. An in home business shall not generate traffic in greater volumes than would normally be expected for a residential area.
(b) In an "B" Residence District only, the following additional restrictions shall apply:
(1) Single family dwellings shall contain no less than 1,250 square feet in area on foundation, exclusive of any garage or porches.
(2) No sign, whether for advertising purposes or otherwise, shall be permitted except:
A. For each single family dwelling, a nameplate, not to exceed one square foot in area.
B. For each single family dwelling, a temporary sign pertaining to the lease or sale of a building or premises not to exceed eight square feet in area.
(3) No fence, wall, or similar partition shall be constructed between the front of a house and the street, except with the approval of the Board of Zoning Appeals. Further, no fence, wall, hedge or similar partition shall be constructed or be permitted to grow so close to an adjacent property, unless the owner of the adjacent property consents in writing to its location. All fences, walls, hedges or similar partitions shall be maintained in good condition and shall be of an acceptable design.
(4) No accessory structure of more than 200 square feet of floor space shall be permitted, except for one garage for each dwelling where no provision for vehicle storage is available in the primary structure. Not withstanding the foregoing, such an accessory structure greater than 200 square feet may be permitted as a conditional use, subject to such terms and conditions as imposed by the Zoning Board of Appeals.
(5) Unless otherwise specifically permitted herein, no parking of motor vehicles, automobiles, trucks, and motorcycles shall be permitted in any front yard.
(6) Any driveway constructed thereon shall be a minimum of eight (8) feet in width and a maximum of twenty (20) feet in width.
