1175.09 ZONING UPON ANNEXATION.
   (a)   Within sixty (60) days of acceptance by the Wood County Board of Commissioners and the Village of Luckey, of a petition for annexation to Luckey, the Planning Commission will take one of the following actions:
      (1)   If the land, prior to annexation to Luckey, had been subject to zoning, the Commission shall designate the district in this Ordinance most similar to the previously existing district. If deemed desirable, the Commission may also select a district in this Ordinance deemed more consistent with orderly development of the area. The Commission shall then hold a public hearing and submit a report to the Village Council.
      (2)   If the land, prior to annexation to Luckey, had not been subject to zoning, the Commission shall select a district in this Ordinance deemed most consistent with the orderly development of the area. The Commission shall then hold a public hearing and submit a report to the Village Council.
 
   (b)   Within sixty (60) days of the public hearing by the Planning Commission, Village Council shall act upon the report of the Planning Commission to establish permanent zoning for the annexed area. Council procedures hall be as in this chapter.
 
   (c)   No zoning permit or building permit shall be issued until permanent zoning is established.
