521.13 PLACING AND REMOVING TRASH RECEPTACLES FROM CURB SIDE PICK-UP AREAS.
   (a)   Each family, person, business, firm, etc., shall secure solid waste collection and disposal services and provide suitable, portable, approved containers for holding all solid wastes. Such containers shall be water tight and provided with suitable handles and a tight fitting lid which shall not be removed, only when necessary in the use of such containers. Plastic bags of high density tensile strength are acceptable containers so long as such plastic bags are securely tied or sealed and are otherwise water tight.
      (1)   “Garbage” includes all wastes or fish, fowl, fruit, vegetable, and animal matter resulting from the preparation of food for human consumption.
      (2)   “Solid waste” includes all putrescible and nonputrescible substances, except as otherwise provided herein.
      (3)   All garbage and solid waste, before being deposited in containers, shall be thoroughly drained of all water and other fluids and securely wrapped in paper or plastic bags.
      (4)   All garbage and solid waste containers shall be placed out of doors in close proximity to each other, and shall be kept in a side or rear yard prior to the transportation of said containers to the curb side area for collection.
      (5)   No person, business, firm, or corporation shall cause to conceal and/or mix hazardous or toxic wastes with garbage or solid waste.
      (6)   In no case shall garbage, solid waste, or containers filled with garbage or solid waste be transported to the curb side area for collection prior to 7:00 p.m. on the evening before said garbage, solid waste, and/or containers are to be collected. Following the collection of garbage, solid waste, and/or containers, no such solid waste, garbage, and/or containers shall remain at the curb side area past 7:00 p.m. on the evening following collection, and everything shall be returned to the side or rear yard area.
   (b)   Whoever violates this section shall receive a written warning upon the first offense. A person who violates any provision of this section after receiving a written warning shall be guilty of a minor misdemeanor for each separate offense.
