(a) Definitions. As used in this section, certain term(s) are hereby defined as follows:
(1) “Dog Kennel” means any structure or premises which houses or contains five or more dogs at least three months of age, whether the dogs are housed or contained for pleasure, profit, breeding or exhibiting.
(2) “Dog Kennel Operator” means any individual or entity which owns five or more dogs at least three months of age, whether the dogs are owned for pleasure, profit, breeding or exhibiting.
(b) Animal Restraint. All dogs housed or contained in any Dog Kennel shall be restrained by the Dog Kennel Operator by use of a fence when the dog(s) is not a shelter.
(c) Sanitary Conditions. All Dog Kennel Operators shall dispose of animal waste by using chemical means so as not to cause undue discomfort in the area. In commercial and private kennels, throughout the months of April through September when the temperature reaches seventy-five degrees or above, waste shall be disposed of every forty-eight hours. At temperatures below seventy-five degree, waste shall be disposed of every seventy-two hours. For all other months of the year, waste shall be disposed of every seventy-two hours. Further, dogs contained or housed in Dog Kennels shall be reasonably restrained by the Dog Kennel Operator from annoying the neighborhood or the general public by loud, frequent or habitual barking, yelping or howling.
(d) Inspection and Permits. Any individual or entity who acts as a Dog Kennel Operator shall obtain a permit to operate a Dog Kennel from the Public Department by an officer designated by the Police Chief. Inspection of the Dog Kennel shall be made every six months or upon a written or oral complaint of a citizen or neighbor. All inspections may be made by the Police Department or Humane Officer, and any citations shall be issued by the designated officer of the Police Department. There shall be a twenty-five dollar fee paid by the Dog Kennel Operator for said permit.
(e) Location. No Dog Kennel license shall be issued for the operation or maintenance of a Dog Kennel in any district zoned as residential. In a commercial or industrial district, no Dog Kennel license shall be issued unless proper zoning requirements have been met.
(f) Violations. Whoever violates any provision of this section shall be issued a citation to correct the violation within thirty days. If after thirty days, the violation still exists, the Dog Kennel Operator shall be cited for a minor misdemeanor for the continuing violation. A separate offense shall be deemed committed each day during which an offense continues.
