(a) Users with an Indirect Discharge Permit or required to Obtain an Indirect
Discharge Permit.
(1) Users covered under or required to obtain an IDP shall comply with the reporting requirements specified in the IDP and in OAC 3745-36. Any report, form, notification or application submitted to Ohio EPA shall also be submitted to the POTW. This includes discharge data, wastewater sampling, notification of daily maximum limit exceedances, anticipated changes to the discharge or production rate, etc.
(2) Each User must notify the Ohio EPA and the POTW of any significant changes to the Users operations or system which might alter the nature, quality, or volume of its wastewater at least 60 days before the anticipated change.
(b) Reports from Unpermitted Users.
(1) All Users not required to obtain an IDP shall notify the POTW and the Ohio EPA of slug discharges, in accordance with OAC 3745-36-05.
(2) Each User must notify the POTW of any significant changes to the User's operations or system which might alter the nature, quality or volume of its wastewater at least 60 days before the anticipated change.
(3) All Users not required to obtain an IDP shall provide appropriate reports to the Ohio EPA and POTW upon request.
(c) Notification of the Discharge of Hazardous Waste. Any User who commences the discharge of hazardous waste shall notify the POTW, and Ohio EPA in accordance with the procedures specified in OAC 3745-36-08(E).
(d) Date of Receipt of Reports. Written reports will be deemed to have been submitted on the date postmarked or emailed. For reports delivered in person during POTW business hours, the date of the receipt of the report shall govern unless proof is furnished that such report was delivered on time. For reports delivered in person outside ofPOTW business hours, the date of receipt of the report shall be the following business day. For notifications given by phone, the receipt of the call will be determined by the time of the voicemail or the time which staff from the POTW answers the phone.
(e) Recordkeeping. Users subject to the reporting requirements of this ordinance shall retain, and make available for inspection and copying, all records of information obtained pursuant to any monitoring activities required by this ordinance, any additional records of information obtained pursuant to monitoring activities undertaken by the User independent of such requirements, and documentation associated with Best Management Practices established under Section 913.02(c). Records shall include the date, exact place, method, and time of sampling, and the name of the person(s) taking the samples; the dates analyses were performed; who performed the analyses; the analytical techniques or methods used; and the results of such analyses. These records shall remain available for a period of at least three (3) years. This period shall be automatically extended for the duration of any litigation concerning the User or the Village or the Ohio EPA, or where the User has been specifically notified of a longer retention period by the Village or Ohio EPA.
