521.16 COMMERCIAL GARBAGE PICKUP, DUMPSTERS AND RECEPTACLES.
   (a)   Any commercial property within the Village of Lowellville must have an enclosure for garbage, dumpsters and receptacles so as to conceal the same and said area shall be designed and used for garbage collection as well.  The enclosure must be fully enclosed on 3 sides at all times with the fourth side being a gate of equal height as the other three sides.  The same shall remain closed except for placing and collecting garbage.  Said enclosures shall be in side or rear yards of said properties.
   (b)   The enclosure heights shall be a minimum of 5 feet tall or at least 1 foot above the height of the dumpster or receptacle therein whichever is taller.
   (c)   The enclosure shall be constructed of brick, stone, solid wood, or an artificial material that simulates brick, stone, or solid wood.  The materials must compliment the other structures on the property.
   (d)   In the Village Preservation District the raw treated lumber shall not be acceptable as an enclosure material and in said district the design and review board must approve all planned enclosures prior to construction.
   (e)   All enclosures shall have a base material of poured concrete or asphalt.
   (f)   Prior to construction of said enclosures in any part of the Village the Village Zoning Inspector must be provided a detailed plan and specifications for said enclosure.  If the Plan and specifications should comport with this ordinance then the Village Zoning Inspector shall issue a permit to construct the same.
   (g)   Any enclosure in existence prior to the existence of this ordinance or dumpster or receptacle without an enclosure in existence prior to the existence of this ordinance shall have 1 year from notification by the zoning inspector to construct an enclosure that complies with this ordinance or to bring the preexisting enclosure into compliance.
   (h)   Whoever violates this section shall be guilty of a minor misdemeanor and shall in addition to any fine or other penalty bring their property into compliance herewith.
