1349.12  UNLAWFUL OCCUPATION.
   If any building constructed as or altered into a dwelling be occupied in whole or in part for human habitation in violation of this Code or without obtaining a certificate of compliance, during such unlawful occupation no rent shall be recovered by the owner or leaser of such premises for such period, and no action or special proceedings shall be maintained therefor or payments of such for possession of the premises for nonrent, and such premises shall be deemed unfit for human habitation.  The authorized inspector may cause them to be vacated accordingly.
