1343.05  APPEALS.
   Any person served with a notice of violation or order which has been issued in connection with the enforcement of this Code may request and shall be granted a hearing on the matter before Council, provided that such person shall file in the office of the Clerk of Council a written petition requesting such hearing and setting forth the name, address and telephone number of the petitioner and a brief statement of the grounds for the hearing.  Petition shall be filed within ten days after the day of notice of violation and order is served and shall be accompanied by a fee of twenty-five dollars ($25.00) to cover the cost of handling the appeal.  Upon receipt of such petition, the Clerk of Council shall set a date not to exceed thirty days, for a hearing before the Board of Building Appeals and shall give the petitioner written notice thereof.  If the violator does not appear for the hearing, the provisions of this Code shall be enforced.
