(a) For the purpose of this Zoning Ordinance, certain words and terms are defined as follows. Words used in the present tense include the future; the singular number includes the plural and the plural includes the singular. The word “lot” includes the word “plot” the word “building” includes the word “structure”.
(1) “Alley” means a narrow thoroughfare upon which abut generally the rear boundary lines of premises and which is twenty feet or less in width.
(2) “Accessory use” or “accessory building” means a use or building customarily incident to and located on the same lot with another use or building, An “accessory building” shall not be constructed on any lot which does not already have a residential or business structure on the lot.
(3) “Condominium” is the same as a dwelling where each family owns its own dwelling unit but where the common areas of the building and site are owned and maintained jointly by the occupants.
(4) “Court” means an open, unoccupied, unobstructed space, other than a yard on the same lot as the building.
A. “Inner court” means a court not extending to a street or way, or to a front or rear yard.
B. “Outer court” means a court extending to a street or way, or to a front or rear yard.
(5) “Depth of rear yard” means the minimum horizontal distance between the extreme rear of a building, and the rear lot line.
(6) “Dwelling” means any house or building or potion thereof which is occupied or intended to be occupied in whole or in part as the home, residence or sleeping place of one or more persons either permanently or transiently.
(7) “Garage” means a building or any portion thereof which one or more motor vehicles are housed, kept or repaired, not including exhibitions or show rooms.
(8) “Half-story” means a story which is situated under a sloping roof, the floor area of which does not exceed one-half of the floor area of the floor immediately below it and which does not contain an independent apartment. A half-story shall not be counted as a story for the purpose of determining yard dimensions.
(9) “Height of buildings” means a vertical distance from the established sidewalk grade at the center of the front of the building to the highest point of the roof surface if a flat roof, to the deck line of mansard roofs, and to the mean height level between eaves and ridge for gabled, hip and gambrel roofs. For buildings set back from the street line “height of building” may be measured from the average elevation of the finished grade along the front of the building.
(10) “Lot” means a piece or parcel of land occupied or to be occupied by one building and its accessory buildings and including the open spaces required under this chapter.
A. “Corner lot” means a lot abutting upon two or more streets at their intersection, provided the angle at which the streets intersect does not exceed one hundred thirty-five degrees.
B. “Interior lot” means a lot the side line of which do not abut any street.
(11) “Nonconforming use” means a use of building or land that does not comply with regulations covering the district in which it is located.
(12) “Rear yards” means a space, unoccupied except by a building for accessory use herein permitted, extending the full width of the lot between the extreme rear line of a building and the rear lot line, excluding steps, uncovered porches and covered but unenclosed porches on the first story which do not exceed more than ten feet beyond the rear wall of the building.
(13) “Row Houses” means a building comprised of no more than six family dwelling.
(14) “Setback” means the minimum horizontal distance between the street line and the front line of the building, excluding steps, uncovered porches and covered but unenclosed porches on the first story which do not extend more than ten feet beyond the front wall of the building.
(15) “Side yard” means an open, unoccupied space on a lot occupied by a building, extending for the full length of the building between the building and the side lot line.
(16) “Story” means that portion of a building included between the upper surface of any floor and the upper surface of the floor next above, or if there is no floor above, the portion between the floor and the ceiling above; also, any portion of a building used for human occupancy between the top most floor and the roof. A basement shall not be counted as a story unless more than one half of the basement height is above grade level at the front of the building.
(17) “Street” means a public thoroughfare more than twenty feet wide, provided, however that any existing thoroughfare less than twenty feet wide, generally known as a street at the time of the passage of this Zoning Ordinance, shall be considered a street for the purpose of this chapter.
(18) “Zoning Ordinance” means Ordinance 675 passed September 28, 1953, as amended, which comprises Title Three of this Planning and Zoning Code.
