905.01  PERMIT AND BOND REQUIRED; EXCAVATION OF  SIDEWALKS.
   (a)   No person or entity shall cut, dig or excavate in any street, avenue, alley, lane, sidewalk or other public way, or tunnel through, under or beneath the surface of any street, lane, alley, avenue, sidewalk of other public way, within the limits of the Village without a permit from the Mayor to do so.  The applicant for such permit shall furnish bond in the sum of five hundred dollars ($500.00) subject to the approval of the Mayor, conditioned that such applicant shall repair and restore such street, lane, avenue, alley, sidewalk or other public way, to its original condition and render it safe for public use, which repairs and restoration shall be done at the expense of such applicant.  The bond shall provide further that such permittee will save the Village harmless from any loss or damage in connection therewith or resulting therefrom, and to reimburse the Village for any claims for damages it may be required to pay in connection therewith or as a result thereof; provided further, that if such bond is insufficient to fully cover such loss or damage, then the permittee shall pay the excess.
   (b)   No person or entity shall be permitted to pave, excavate or alter any sidewalk in connection with the pavement, excavation, alteration or repair of a driveway or driveway apron without the sidewalk which crosses the driveway or driveway apron being maintained as a concrete sidewalk, or returned to a concrete sidewalk.  That portion of the driveway or driveway apron which crosses the sidewalk shall be kept at the same grade as the sidewalk so as to avoid interference with pedestrian traffic, and no steps shall be created in the sidewalk.
