§ 99.06 WHERE SMOKING IS NOT REGULATED.
   The prohibitions of §§ 99.03 and 99.04 shall not apply to the following:
   (A)   Private residences, except when used as a licensed childcare, adult day care or health care facility.
   (B)   Hotel and motel rooms that are rented to guests and are designated as smoking rooms; provided, however, that not more than 20% of rooms rented to guests in a hotel or motel may be so designated. The status of rooms as smoking or nonsmoking may not be changed, except to add additional nonsmoking rooms.
   (C)   Outdoor areas of places of employment, except as otherwise prohibited by this chapter.
   (D)   Retail tobacco stores that are registered with the town and are in existence at the time this chapter is passed; provided that smoke from these places does not infiltrate into areas where smoking is prohibited under the provisions of this chapter.
   (E)   A bar, provided that:
      (1)   No person under the age of 21 is allowed to enter at any time and it employs no person under the age of 21; and
      (2)   If it is located in a building which contains a restaurant, private club, or any other public place, the bar is mechanically separated from the dining/food preparation areas of the restaurant, and from the public areas of all other establishments, and the bar’s ventilation system meets the standard air-exchange requirement of 20 to 30 air exchanges per hour, as certified by the authorized representative of a business which designs, installs or inspects heating, ventilation and air-conditioning systems and which is licensed in Lake County or the Town of Lowell.
   (F)   Places of employment provided that the enclosed areas they occupy are not open to the public.
   (G)   The following places within the Moose Lodge:
      (1)   The first floor meeting room; and
      (2)   The social quarters, except during times when dinner is served or when any person under the age of 21 is present.
