The pretrial diversion program offers persons charged with criminal offenses or municipal violations an alternative to traditional criminal justice or juvenile system proceedings by:
(A) Permitting participation of the accused only on a voluntary basis;
(B) Having access to counsel prior to an adjudication when a decision has been made by the prosecutor that the offense will support criminal charges; and
(C) Resulting in the dismissal of charges or its equivalent, if the individual successfully completes the diversion process.
