(A) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
MINOR CHILD. Any person who is less than 18 years of age.
WEEK NIGHTS. Commencing at 10:00 p.m. on Sunday and concluding at 6:00 a.m. on Friday.
WEEKENDS. Commencing at 6:00 a.m. on Friday and concluding at 10:00 p.m. on Sunday.
(B) Curfew. It shall be unlawful for any person less than 18 years of age to be upon or remain upon any street, alley, or other public place within the city from 10:30 p.m. to 6:00 a.m. on week nights or between 12:00 a.m. and 6:00 a.m. on weekends, unless the person is accompanied by a parent or guardian or other person, not a minor, who has custody of the minor. A minor child traveling to, from, or during lawful employment shall be exempt from the provisions hereof, provided he or she follows the most direct route to, from, or during the employment. Provided, further, it shall be unlawful for any person 15 years of age or younger to be upon or to remain upon any street, alley or other public place within the city from 10:30 p.m. to 6:00 a.m. on week nights or weekends, unless the person is accompanied by a parent or guardian or other person, not a minor, who has custody of the minor.
(C) Issuance of citation. Every law enforcement officer within the city is hereby authorized to issue a citation to the parent or guardian of any minor child in violation of the provisions of this section. If the parent or guardian cannot be found, a report of the violation shall be referred to the City Attorney.
(D) Duty of parent, guardian, or legal custodian. It shall be the duty of any parent, guardian, legal custodian, or person having legal care and custody and control of a minor child, as defined herein, to control the minor child so that he or she is not in violation of this section. It shall be unlawful for any parent, guardian, legal custodian, or person having legal care and custody of a minor child defined herein to allow or permit the child to go or be upon any public street, alley, or other public place in the city in violation of this section.
