§ 98.02 RESTRICTIONS ON BOATING AND DOCKING.
   (A)   No person shall tie up to, moor, or anchor outboard of a boat moored at the City Wharf.
   (B)   No person shall tie up to, moor, or anchor to the City Wharf west of Second Street Bridge without an individual permit issued by Waterfront Development Corporation.
   (C)   No person shall anchor a boat in the Ohio River south of the navigation channel between the northwest corner of the Great Lawn and the Second Street Bridge.
   (D)   No person shall anchor a boat or otherwise impede commercial vessel traffic in the navigation channel.
   (E)   No person may beach a boat or tie up to trees, other vegetation or structures in Waterfront Park.
   (F)   No person shall dock in the harbor in Waterfront Park without obtaining a permit from the Waterfront Development Corporation in accordance with § 98.03.
   (G)   During events at Waterfront Park, an "Authorized Anchorage Area" exists south of the navigation channel between the northwest corner of the Great Lawn and the Big Four Bridge.
   (H)   Any boat unattended at a public docking, mooring or anchorage area adjacent Waterfront Park for over 48 hours maybe tagged and impounded in place, or moved to another location at owner's expense. Metro Government shall attempt to contact owner by certified mail. If owner does not respond within ten days of the mailing date, notice of abandonment will be published in the local newspaper of largest circulation. If owner does not respond within 30 days of notice, boat will be deemed abandoned, and boat shall escheat to the Metro Government for governmental use. Metro Government or its agent, Waterfront Development Corporation, may obtain a certificate of registration and ownership from the Jefferson County Clerk. Metro Government then may sell the boat at auction or scrap the boat.
   (I)   Any commercial boat docked, moored, or anchored, adjacent to property owned by Metro Government without a valid permit, or in default of a contract allowing occupation of that site, may be tagged after 48 hours and impounded in place or moved to another location at owner's expense. If owner does not satisfy expenses and move boat within 30 days, boat will be deemed abandoned, and boat shall escheat to Metro Government. Metro Government may obtain a certificate of registration and ownership from the Jefferson County Clerk. Metro Government then may use the boat for governmental use, sell the boat at auction, or scrap the boat.
   (J)   Nothing herein shall prohibit the Waterfront Development Corporation from operating a boat for the purpose of maintaining the shoreline and other features of Waterfront Park.
