(A) Louisville Metro hereby establishes an Entertainment Destination Center ("EDC") at the NuLu Marketplace upon the belief that the NuLu Marketplace satisfies the requirements contained in the definition of an EDC as required by Section 1 of 804 KAR 4:370, including the belief that the NuLu Marketplace will aid economic growth and tourism in Louisville Metro and for the community around the NuLu Marketplace area.
(B) The geographical boundaries of the NuLu Marketplace EDC lies within and adjacent to the following description:
Beginning at a point on the North right-of-way line of East Market Street, said point also being the Southeast corner of the property and the Point of Beginning; thence running along said right-of-way, N 81°18'11" W, 157.50 feet to a point; thence leaving said right-of-way, N 8°49'15" E, 194.38 feet to a point in the South right-of-way line of Billy Goat Strut alley; thence along said alley right-of-way, S 81°14'55" E, 157.50 feet to a point; thence leaving said alley right-of-way S 8°49'15" W, 194.23 feet to the Point of Beginning, and containing .70 acres more or less.
The area designated for the EDC shall also include the sidewalks adjacent to the above-referenced parcel on East Market Street.
(C) The NuLu Marketplace EDC hours are as follows: Monday through Saturday 11:00 a.m. until 2:00 a.m. and Sundays 11:00 a.m. until 11:00 p.m.
(D) The NuLu Marketplace shall comply with all applicable laws and licensing requirements to operate as an EDC.
