§ 40.21 INSURANCE AND RISK MANAGEMENT FUND.
   (A)   There is hereby continued the Metro Government Insurance and Risk Management Fund, which shall receive all funds in the City of Louisville and Jefferson County insurance and risk management accounts. Appropriations from insurance charges to agency operating budgets, plus any balance remaining in Insurance Administration at the end of a fiscal year shall be transferred to the Metro Government Insurance and Risk Management Fund. Payments from the Metro Government Insurance and Risk Management Fund are hereby authorized and restricted to expenses for insurance premiums, excess insurance premiums, claims adjustments and expenses, loss control and safety engineering fees, legal fees and other administrative costs, in conjunction with insurance or benefit administration, or exposures to loss for which the City of Louisville, Jefferson County or the Metro Government has elected or will elect to be self-insured and for payment of claims and judgments arising from the same exposures to loss in accordance with the procedures, discretion and determination vested in the County Attorney and Mayor hereunder. Any unexpended balance remaining at the close of a fiscal year shall not lapse but shall continue into the succeeding fiscal year.
   (B)   All cases, hearings, and proceedings in and before all courts, tribunals, or commissions, and all claims pending against the City of Louisville and Jefferson County and all claims which may hereafter be presented against the Metro Government for injury or damage, whether suit is or is not pending on these claims, shall be presented or referred to the County Attorney. The County Attorney, with the approval of the Mayor, is specifically authorized, empowered, and directed to settle and compromise such claims on the terms that the County Attorney deems most advantageous and for the best interests of the Metro Government or to pay any final judgments rendered against the Metro Government. The County Attorney is empowered and directed to draw on the Risk Management Fund transferred from the City of Louisville and the Risk Management Fund transferred from the County of Jefferson, or any other funds appropriated for the payment of such judgments, claims and compromises. The authority for so doing is conferred by the Council within the limitations herein prescribed, the same as if each individual payment, settlement, or compromise had been specifically authorized and approved.
