§ 115.221 LIFEGUARDS REQUIRED; PERMIT.
   (A)   No person shall operate a public swimming and bathing facility within Louisville Metro unless there is in attendance at such pools or places at all hours during which the pools or places are open, one or more Water Safety Personnel duly qualified under the provisions of Chapter 901 of the Louisville Metro Board of Health Sanitary Code. Provided, however, that this requirement does not apply to any public swimming and bathing facility exempted by Section 900.15 of the Louisville Metro Board of Health Sanitary Code Chapter 900.
   (B)   It shall be unlawful for any person to employ Water Safety Personnel unless such Water Safety Personnel has obtained a certificate in writing from the Department.
   (C)   Public swimming and bathing facilities with pools having less than 2,000 sq. ft. of water surface area and five feet or less in depth shall not be subject to the water safety personnel requirements set forth in Section 900.15 of the Louisville Metro Board of Health Sanitary Code Chapter 900 unless the facility has unlocked access and/or allows bathers 16 years of age or under to enter the facility area without a responsible person 17 years of age or older.
   (D)   All other relevant portions of Kentucky statutes, Kentucky Regulations and Local Health Rules regarding lifeguards and water safety personnel shall apply.
