§ 35.001 PERSONNEL POLICIES.
   (A)   The Director of the Department of Human Resources ("Director") shall have the authority to establish and promulgate rules and regulations for personnel administration for Metro Government, including description and classification of non-elected positions; selection, assignment, supervision and discipline of employees; the hours necessary for full- and part-time employment, which need not be uniform between the various classes or departments; administration of employee complaints and grievances; and, subject to available funds, a personnel pay and classification plan setting salary levels and establishing employee benefits.
   (B)   The Director shall submit a personnel pay and classification plan to the Metro Council at the time of the annual budget. Until such initial plan for Metro Government is presented, employees shall continue to be compensated under either the prior Jefferson County or City of Louisville classification and compensation plans, the type and character of benefits, and the policies and procedures, as applicable and in place at the passage of this subchapter. Thereafter, employees shall be compensated pursuant to the personnel pay and classification plan as provided in the Personnel Policy.
   (C)   The Director shall verify and approve the employment, compensation, promotion, demotion, and termination of an employee in compliance with the applicable provisions of personnel regulations and policies before such action becomes effective.
   (D)   Nothing contained in this subchapter shall be construed to deprive the Louisville/Jefferson County Metro Civil Service Board, Louisville/Jefferson County Metro Merit Board, or the Louisville Metro Police Merit Board of their respective jurisdiction.
   (E)   Nothing contained herein shall be construed to modify, change, or repeal any of the provisions of collective bargaining agreements now or hereafter entered into. The rate of pay, benefits, and working conditions for employees covered by collective bargaining agreements shall only be as provided for in those agreements during their terms. However, no collective bargaining agreement shall be deemed to grant a vested right to a particular classification title and such titles shall be considered descriptive only.
